Record Search & Risk Assessment

The Record Search Risk and Assessment is an environmental due diligence option for low-risk properties described by the United States Environmental Protection Agency Standard Operating Procedures. The RSRA includes an environmental database and a historical review of the property. A letter report is prepared to summarize the findings and makes a determination whether the property is ‘high risk’ or ‘low risk’. If the property is deemed high risk, typically a Phase I ESA is recommended in Texas.

In the United States, an environmental site assessment is a professional report prepared for a property or real estate holding that identifies potential and existing environmental contamination liabilities. The environmental site analysis, often abbreviated as an ESA, typically addresses both the underlying land as well as physical improvements to the land or property.

The main purpose of a Phase 1 ESA (environmental site assessment) report is to assess if current or historical property uses have impacted the soil or groundwater beneath the property and could pose a threat to the environment and/or human health. If these environmental issues and threats are found, it presents a potential liability for the lender and/or owner of the property, as well as affecting the value of the land.

A Phase I ESA completed prior to the closure of a real estate transaction can be used to meet the requirements of CERCLA’s (Comprehensive Environmental Response, Compensation and Liability Act) innocent landowner defense under All Appropriate Inquiries (AAI).
